Welcome to To The Nines. The following Terms of Service (“Terms”) between you (“you”, “your” or “renter”) and To The Nines, (“we,” “our,” “us,” or “To The Nines”) describes the terms and conditions on which you may access and use the To The Nines website located at www.tothenines.ph (the “website”) and related Services including rental of our products (“garment”, “product”, “item”, or “rental”).

By accessing or using any of the Services, you acknowledge that you have read, understood and agreed to be bound by these Terms.

 We reserve the right to change the Terms of this agreement in the future. Any changes will apply to the rental of any products after such change.

 

Eligibility

The Service is only available to individuals over 18 years of age. Products may be rented for use by minors between the ages of 13 to 18, through parents and/or legal guardians who are eligible individuals. By agreeing to these Terms, you represent that you are 18 years or older and that you are authorised to use the approved payment method for the purpose of renting the Products as described in these Terms. You agree and acknowledge that you are renting the products and that ownership of the products remains with To The Nines at all times.

If you are a parent and/or legal guardian agreeing to these Terms for the benefit of a minor between the ages of 13 and 18, you are fully responsible for his or her use of the Services, including any legal liability he or she may incur. Children under the age of 13 may not use the Services and parents and/or legal guardians may not agree to these Terms on their behalf.

 

Rental Period

The rental period immediately begins when the product/s have been delivered to the indicated address, regardless of the recipient. The period ends when the rentals have been returned in an acceptable condition, as inspected by us. You are responsible for the products while they are in your possession and as such, you are expected to exercise proper diligence as if they were your own items.

In the event that the rentals are damaged, we will assess the product and inform you of the additional charges to be deductible from the security deposit for its repair. Please note that you are liable for repair or replacement of the garment. If the charges should be higher than the security deposit, you agree to pay any extra charges for its repair or replacement up to its full present value as determined by To The Nines.

To The Nines shall not be liable for failure to perform any of its obligations hereunder by reasons that are beyond its reasonable control, including (without limitation) fire, earthquake, interruptions in supply, other natural disasters, war embargo, and/or riots or acts of terrorism.

 

Payment

The rental fee (“Rental Fee”) for the Product will include the product fee and security deposit. Upon rental of a product, you hereby are agreeing to pay for the Rental Fee through any of the following payment methods: debit or credit card, Paypal, or bank transfer (“approved payment method”). A reservation of a Product is considered an order for the rental of that Product, regardless of how far in advance that Product is reserved. Payment of the rental fee must be made at least 3 days prior to delivery of the product. If the Rental Fee is not received through an approved payment method at least 3 days before delivery, the rental shall be cancelled.

In addition, at the time of your order of a product, you hereby agree to pay To The Nines via an approved payment method for the full present value of the product set forth on To The Nines' Rental Agreement, in case of damage or loss as set forth above.

 

Security Deposit

The security deposit will be fully refunded upon collection and inspection of the garment if To The Nines has determined that there is no major damage to the item. In case of major damages, the amount for repair will be deducted from the security deposit. You agree to pay for any extra charges should the amount for repair exceed the security deposit. Major damages include stains, rips, missing beads, stuck zippers, and others, as determined by To The Nines.

 

Late Fee and Cancellations

You may cancel your order for products, but note that the full Rental Price will only be refunded if the cancellation is made 3 days before the stipulated rental period. If it is made 48 hours prior to delivery date, we will refund 50% of the Rental Price, or 10% if it is done within 24 hours.

If the product/s are held beyond the agreed rental period without our consent, we will charge you P500.00 per day in addition to any damages, which may be determined in a proper collection suit.

If the renter cannot be contacted or is unavailable during the agreed delivery/pickup times, leading to a failed delivery/pick-up of the rental, you will be charged accordingly for additional arrangements to deliver/pick up the item.

If there are any changes to delivery and/or return address, and/or approved payment methods, and/or dates or times, To The Nines must be notified at least 24 hours before the original delivery and/or return date. For Monday deliveries/pickups, renter has to inform To The Nines of any changes by Friday 6PM. If we are not informed before the cut-off time, the charges for last-minute changes will be P500.00 for each day from the required period of notification.

 

Laundry

The products will be professionally cleaned and delivered ready for wear. We dry clean and inspect each product with the utmost care, but use of the product is at your own risk. To The Nines shall not be held liable for any health-related complaints associated with a product rented from our site.

 

Delivery

We will deliver the products on or before the specified date and time, except to the extent we informed you of any delays or issues with the product or with the shipment. Products may appear different in colour and style than the photos displayed on our website. Our liability to you for failure to deliver the product as ordered is limited only to the timely delivery of product. You will be entitled to a refund of the Rental Fee (excluding delivery charges).

 

Receipt of Products

Upon delivery, you will bear responsibility for the receipt of the product/s at the indicated address on the specified date and time. You acknowledge that the indicated address is a secure shipping address. A secure shipping address is defined as a location where an individual can physically receive product/s. In the event that an unsecure shipping address is provided, To The Nines does not bear liability for products left unattended. Furthermore, you acknowledge that providing anything other than a secure shipping address may result in delivery delays and additional delivery fees for which To The Nines is not to be held liable.

 

Use of Products

You agree to treat the products with great care. You are responsible for loss, destruction, or damage to the products due to theft, mysterious disappearance, fire, and any other causes. If you return a product that is damaged and cannot be covered by the security deposit, you agree to pay for additional charges including the price for repairing or replacing the product, as determined by our discretion, up to the present value of the product.

You will also assume sole and exclusive responsibility and liability for any claims against you and/or damages arising from use of the products during your rental period.

 

Return of Products and Extension Requests

You agree to return the products to To The Nines in its original garment bag or dust bag and with its original hanger on the date set forth on the website in connection with your rental. You may extend your rental by writing us an email at contact@tothenines.ph, provided that there are no pending rentals for the product.

Failure to return the product/s at the end of the agreed upon Rental Period will render you liable for a late fee of P500.00 for every day you are late, on top of the initial rental fee already charged and other losses To The Nines will incur because of this. Failure to return the product/s in its original bags will be subject to additional charges made to your account to cover its cost.

 

Return of Unworn Rentals Due to Size

If your rental does not fit, you may return the product to us within 24 hours (excluding Sundays and holidays) from the date you received the rental by contacting us via email at contact@tothenines.ph or phone and returning the product in its original garment bag or dust bag and with its original hanger. We will then issue you a reimbursement for the full Rental Fee (less delivery charges) of the product, so long as the product, based on our sole discretion, has not been worn.

 

Collection Suit

If you do not pay the amount owed to us when due, we will not hesitate to institute collection procedures. You agree to pay our costs of collection, including (without limitation) reasonable attorneys’ fees.

 

Refusal of Service

We reserve the right to terminate your rental of products from us at any time in the event of your breach of this agreement, or for unspecified reasons, or any other reason based on our discretion.

 

Your Data

To The Nines is committed to ensuring the confidentiality, security and protection of your personal data. Your data will not be shared to third parties without your consent and will only be used for the purposes you consent to. We will only retain your personal data for as long as it is necessary to fulfill said purposes.
